The Story behind Cession Money

I REFER to Prof Ranjit Singh’s article, “It’s time to close the chapter” (Sunday Star, March 10) in which he argued that Malaysia should immediately stop paying the so-called quit rent or cession money to the heirs of the ancient Sultanate of Sulu.

I am surprised that historian Ranjit Singh had failed to mention that the cession money which is still being paid to the heirs of the Sultan of Sulu until this day is in fulfillment of a High Court of North Borneo order of 1938, which allowed the petition of nine Sulu heirs to receive and share between them the RM5,300 (at today’s rate) annual payment that was previously made to the Sultan of Sulu before he died in 1936.

The Sultan died without leaving any direct heirs. That was why nine less direct descendants of his were recognised and allowed to inherit the money at that time.

And the text of the 1938 judgment made it clear that the right to the money had nothing whatsoever to do with any question of sovereignty.

In my view, Malaysia needs to continue honouring the 1938 court judgment because any violation of a court order can be challenged in court by interested parties. Malaysia should not allow such an opportunity to arise. Many dubious heirs, I am sure, are simply waiting for such a public relations opportunity.

A court order must be carried out unless a settlement is made to settle the matter out of court.The nine heirs who received the court judgment in 1938 have all died.

We simply do not know how many people now claim to be the second or third generation of heirs.This adds to the problem of finding the genuine heirs to settle the issue of cession money, perhaps in a lump sum payment.

The more difficult issue, however, is how to get the Philippines Government to drop their so-called Sabah claim since the Philippines Government has taken the position that it is maintaining that claim because the heirs had given them the right to do so in 1962.

As such, Malaysia should never effect a final settlement with the heirs unless Manila officially drops their so-called claim to Sabah at the same time.

Then, there is this question about a self-proclaimed Sultan who sent some followers to create trouble and kill people in Sabah.

In this 21st century, any attempt by any individual to claim other people’s territory as a state belonging to him should be treated merely as a black comedy.

This is particularly so since the so-called Sultan is merely one of several pretenders who have no land to call their own kingdom and whose position has no legal standing in their own country.

Finally, everyone should take note that in 2001 the International Court of Justice (ICJ) rejected the attempt by the Philippines to intervene in the case between Malaysia and Indonesia citing that they had a legal interest in the matter before the court.

The sentiment of the court was reflected by Judge Ad Hoc Frank who wrote, in his separate judgment: “Modern international law does not recognize the survival of a right to sovereignty based solely on historic title; not in any event after an exercise of self determination conducted (in Sabah in 1962) in accordance with the requisites of international law, the bona fides of which has received international recognition by the political organs of the United Nations. Against this, historic claims and pre colonial titles are mere relics of another international legal era, one that ended with the setting of the sun on the age of colonial imperium”.

Hentikan bayaran kepada waris Kesultanan Sulu, kata Karpal

KUALA LUMPUR – Peguam Karpal Singh berkata kerajaan harus segera menghentikan bayaran penyerahan wilayah tahunan sebanyak RM5,300 kepada individu yang mendakwa diri keturunan Kesultanan Sulu.
   
Karpal berpendapat bayaran itu adalah suatu kesilapan terutama selepas Sabah mencapai kemerdekaan dan berkata keturunan Kesultanan itu tidak mempunyai locus standi bagi menerima bayaran berkenaan.
   
“Hanya kerajaan Filipina mengambil beberapa langkah dalam membuat tuntutan ke atas hak wilayah Sabah kepada Mahkamah Keadilan Antarabangsa (ICJ), namun selepas lawatan rasmi bekas Presiden Ferdinand Marcos pada lewat 1960-an dan perlakuan pentadbiran selepas beliau, mereka sudah mengetepikan tuntutan itu.
   
“Ini boleh dilihat dengan jelas daripada tindakan kedua-dua kerajaan yang bersetuju mempertingkat hubungan diplomatik daripada status konsulat kepada duta, (yang membuktikan bahawa) kemerdekaan Sabah diiktiraf kerajaan Filipina,” katanya ketika ditemui di Kompleks Mahkamah di sini hari ini.
   
Karpal juga berkata beliau bersetuju dengan pendirian tegas kerajaan yang tidak mahu berunding dengan penceroboh dan penggunaan kekerasan bagi mengusir mereka dari Sabah.
   
“Pasukan keselamatan tidak seharusnya membenarkan sebarang kesilapan keselamatan selanjutnya dengan bertindak segera menghapus segala unsur ekstremis yang mungkin masih wujud di Sabah,” katanya. – Bernama

SEMINAR PENCERAHAN: PUNCA & PENYELESAIAN PENCEROBOHAN DI SABAH

Assalamualaikum warahmatullahi wabarokatuhu…

Setelah hampir sejam berbincang dengan Puan Sabariah Abdullah petang kelmarin di pejabat Saba Islamic Media Sdn Bhd, maka beliau mengambil keputusan untuk membantu menyelamatkan keadaan dengan menganjurkan mini seminar di ruang IIS supaya para NGO dan mereka yang mencintai keamanan mendapat pencerahan.

Kerajaan dan rakyat Malaysia wajib diberikan pencerahan bagaimana konflik Sulu bermula semenjak zaman kolonialis sehingga selepas perang dunia ke II, konflik Sulu dengan Filipina yang kemudian membawa kepada pencerobohan sebilangan kecil pengaku Tentera Diraja Sulu KIRAM ke Sabah. 

Dalam seminar mini ini saya selaku penceramah akan cuba memberikan pencerahan sebaik mungkin untuk membantu meleraikan permasalahan ke arah satu tindakan “menang-menang” kepada umat Islam Sulu dan umat Islam Malaysia. Sangat jelas, kesengsaraan umat Islam Sulu yang sejarah perangnya lebih panjang dan lebih berdarah dari PALESTIN itu telah pun ditunggangi oleh anasir luar.

Oleh yang demikian, saya akan membentangkan juga beberapa analisis siapa sebenarnya yang MENUNGGANGI sebilangan kecil masyarakat Sulu ini. 

Antara tajuk yang akan dibahas ialah:

  • Sejarah Peperangan Sulu dengan Spanyol secara ringkas.
  • Pemilikan Sabah dari Brunei kepada Sulu, kemudian kepada Inggeris secara Pajak dan disambung oleh Malaysia.
  • Benarkah wilayah Sulu itu berjaya menjadi wilayah Filipino? Apakah akibatnya kalau pengaku Sultan Sulu itu menjadi Filipino?
  • Menjelaskan secara ringkas tentang sejarah MNLF, MILF dan Abu Sayyaf serta peranan Tun Datu Mustapha membantu saudara seagamanya di Sulu mempertahankan diri dari serangan Filipina tahun 1972.
  • Perseteruan Keluarga Kiram dengan Tun Datu Mustapha sebelum North Borneo sertai Persekutuan Malaysia 16 September 1963.
 
Juga akan membahas, bagaimana cara kenaikan Sultan Sulu yang sah di masa akan datang yang diangkat Rakyat Jelata Sulu akan menjadikan SABAH itu menjadi KEKAL berada dalam tangan MALAYSIA sampai kiamat. Satu rahsia yang tidak pernah diketahui oleh sejarahwan kita hari ini bahawa dengan mematuhi perjanjian pajakan 1878 itu, Sabah akan kekal ditangan PEMAJAK buat selama-lamanya selama mana PEMAJAK itu mematuhi konteks SYARAT “SELAMA ADA BULAN DAN BINTANG NORTH BORNEO ITU KEKAL SEBAGAI PAJAK. Maka Bulan dan Bintang ini akan dibahas secara mudah difahami sebagaimana yang difahami oleh masyarakat Sulu.
 
Kaedah Bulan dan Bintang sebenarnya akan memerangkap KIRAM.

Washington Backed Anwar, Sabah and Western Sponsorship of Terrorism

Coincidence? West’s use of terrorism raises concerns latest violence in Sabah is linked to Wall Street’s campaign to install Anwar Ibrahim as head of Malaysia.

Disturbing and bizarre reports of Philippine-based armed “Islamist” militants landing on the beaches of Malaysia’s state of Sabah, directly ahead of national elections has raised both concerns and suspicions regarding the Malaysian opposition’s involvement, and that of its Western sponsors. The Star/Asia News Network reported in an article titled, “Najib: Govt to investigate claims of Opposition instigating Sulu Sultanate to reclaim Sabah,” that:

The Prime Minister has directed Malaysian intelligence to investigate claims that the Opposition was among parties responsible in instigating the heir of the Sulu Sultanate to reclaim Sabah.

Anwar Ibrahim, head of Malaysia’s opposition coalition, which includes the Malaysian Islamic Party (PAS), has spent a lifetime in the service of Western interests. Anwar Ibrahim was Chairman of the Development Committee of the World Bank and International Monetary Fund (IMF) in 1998, held lecturing positions at the School of Advanced International Studies at Johns Hopkins University, was a consultant to the World Bank, and a panelist at the Neo-Con lined National Endowment for Democracy’s “Democracy Award” and a panelist at a NED donation ceremony – the very same US organization whose subsidiaries are funding and supporting Bersih, a faux-pro-democracy Western-fundedstreet movement that in fact was created by, and in the service of Anwar Ibrahim’s political ambitions.

Anwar Ibrahim’s affiliations with Malaysian “Islamists,” and his Western backers’ habitual support for terrorism internationally as a geopolitical tool, raises the possibility that his opposition movement is complicit in the conveniently timed militant destabilization Malaysia now faces, only months before 2013′s general elections.


While Wall Street props up Anwar Ibrahim, his political coalition, and his street front, Bersih, it is funding and arming hardcore Al Qaeda terrorists from Libya and Syria, to Iran and Pakistan. Recent announcements by the US and UK that they will be funding to the tune of millions, Syrian “opposition leader” Moaz al-Khatib who openly collaborates with, embraces, and adamantly defends Al Qaeda’s Syrian franchise al-Nusra, is indicative of a global, systematic state-sponsorship of terrorism by the West. Similar support was given to the political fronts of the Libyan Islamic Fighting Group (LFIG) in Libya, who is in fact sending fighters, cash, and heavy weapons into Syria via NATO-member Turkey.Anwar Ibrahim and his political opposition party’s ties to militant terrorists are being investigated, but Malaysia, and other nations in Southeast Asia must be ever vigilant of a West who props up political parties under the guise of “democracy promotion,” while funding and arming terrorists, criminal cartels, and notorious human rights abusers, many times worse than the political parties they seek to subvert.
